X-TENDO — TERMS OF SERVICE

Welcome to X-tendo. These Terms of Service govern access to our website, products, and services, including retail and wholesale purchases. By using the site or placing an order, customers agree to these Terms and applicable policies.

1. ELIGIBILITY AND LAWFUL USE

You must be 21 years of age or older to enter this website or place an order. Customers must also meet any additional legal purchasing requirements applicable in their jurisdiction. Products are for lawful use only. Customers are responsible for complying with applicable federal, state, and local laws. X-tendo may refuse or cancel orders as reasonably necessary for legal compliance or fraud prevention.

2. PRODUCT INFORMATION AND COMPATIBILITY

X-tendo strives to provide accurate descriptions, specifications, images, and compatibility information. Customers should verify compatibility before purchasing and follow all safety instructions. Except where liability cannot legally be excluded, X-tendo is not responsible for damage from misuse, improper installation, unauthorized modifications, or incompatible equipment.

3. ORDERS, PRICING, AND PAYMENT

Prices are in U.S. dollars unless otherwise indicated. X-tendo may correct pricing errors, update product information, limit quantities, or cancel orders for legitimate business reasons. Orders are subject to acceptance, availability, and payment authorization. Applicable taxes, shipping, and disclosed charges are shown at checkout. All sales will appear as XTENDO.COM on your billing statement.

4. SHIPPING AND DELIVERY

Shipping options, charges, and estimates are presented at checkout where applicable. Customers must supply accurate shipping information. Delivery estimates are not guarantees. Please review our Shipping Policy. Applicable statutory rights remain unaffected.

5. RETAIL RETURNS AND REFUNDS

Retail returns, exchanges, refunds, and replacements are governed by our published Returns & Refunds Policy and applicable law. Contact X-tendo before returning merchandise. Damaged, defective, or incorrect merchandise will be reviewed for an appropriate lawful remedy. Replacements may be offered where permitted by law.

6. WHOLESALE PURCHASES

Wholesale purchasing is limited to approved businesses and authorized resellers. X-tendo may verify credentials, request resale documentation, establish minimum order quantities, and approve or decline wholesale account applications. Wholesale prices and purchasing privileges are reserved for approved wholesale customers.

7. WHOLESALE RETURNS AND 25% RESTOCKING FEE

All wholesale sales are final unless a return is expressly approved in writing by X-tendo. Approved wholesale returns are subject to a 25% restocking feebased on the original purchase price of the merchandise being returned. Returns require prior written authorization. Merchandise must be unused, undamaged, complete, and in original resaleable packaging. The wholesale customer pays return shipping unless otherwise agreed in writing. Original shipping and handling charges are nonrefundable unless required by law. Returned merchandise is inspected before a refund or credit; approved refunds or credits are reduced by the applicable restocking fee. The fee does not apply to verified defective or incorrectly shipped merchandise, or where prohibited by law. X-tendo may reject unauthorized or ineligible returns subject to applicable law.

8. PRODUCT SAFETY AND CUSTOMER RESPONSIBILITIES

Inspect products before use and follow product instructions. Do not use damaged, defective, or incompatible equipment or modify products in a manner creating unreasonable safety risks. Customers are responsible for lawful use.

9. INTELLECTUAL PROPERTY

X-tendo trademarks, logos, product designs, site content, photographs, graphics, and other proprietary materials belong to X-tendo or their respective rights holders. Buying a product does not transfer intellectual property rights. Unauthorized reproduction or commercial use of protected materials is prohibited except where permitted by law or written authorization.

10. WARRANTIES AND LIMITATION OF LIABILITY

Products are subject to applicable express warranties and warranties that cannot be excluded. To the extent permitted by law, X-tendo disclaims other warranties and liability for losses resulting from improper use, unauthorized modifications, or failure to follow instructions. Nothing excludes liability that cannot lawfully be excluded.

11. FRAUD PREVENTION AND ORDER CANCELLATION

X-tendo may review, decline, or cancel transactions reasonably suspected of fraud, unauthorized activity, or legal violations. Additional verification may be requested. If X-tendo cancels an order after payment, an appropriate refund will be issued according to law.

12. PAYMENT DISPUTES AND CHARGEBACKS

Customers are encouraged to contact X-tendo about order problems, billing discrepancies, or disputes. X-tendo may investigate and provide records to payment processors and contest fraudulent or inaccurate chargebacks. Legally protected chargeback and dispute rights are not restricted.

13. THIRD-PARTY SERVICES

Our site may use outside providers for payment processing, shipping, analytics, and related operations. X-tendo remains responsible for obligations imposed by applicable law. Outside providers may have their own terms.

14. GOVERNING LAW AND NATIONWIDE SALES

X-tendo offers products to customers throughout the United States, subject to applicable federal, state, and local laws. These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles, except where mandatory laws of another jurisdiction apply. Nothing in these Terms shall limit or waive consumer rights or legal protections that cannot lawfully be excluded under applicable federal or state law. Customers are responsible for ensuring products purchased from X-tendo may be lawfully purchased, possessed, and used in their jurisdiction. X-tendo reserves the right to restrict or cancel shipments to locations where sales are prohibited by applicable law.

15. CHANGES TO THESE TERMS

X-tendo may update these Terms from time to time by posting revisions on its website. Changes apply prospectively and will not retroactively alter completed transactions or existing contractual rights except as legally permitted.
